Terms of Service
Please read these terms carefully before using JAExams services. Only the German law applies.
These Terms of Service ("Terms") govern your use of the website and services provided by JAExams, operated by Alan Paupiah as an individual entrepreneur in Germany ("Provider").
By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.
The Provider offers software for exam administration and management ("Vision", "Classic Display", and related services).
The Provider strives to ensure uninterrupted availability of the services but cannot guarantee 100% uptime due to technical maintenance, updates, or factors beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the services at any time without prior notice.
For customers purchasing "Vision" (Vision Display) or "Classic" (Classic Display/Pro/Enterprise) services:
- License Activation: Please note that after purchasing Vision or Classic, it may take up to 24 hours for your license key to be assigned and activated.
- Local Backup: We strongly recommend downloading and maintaining a local variant/backup of the exam environment.
- Display Reliability: JAExams is not responsible for any crashes, interruptions, or failures of the display or exam environment (Classic or Vision) during an active exam session. We expressly point out that local variants are available for download to mitigate this risk. You acknowledge that relying solely on the hosted version carries inherent risks of internet connectivity and browser stability.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
You must provide accurate and complete information during registration. We reserve the right to suspend accounts providing false information.
Payments are processed via third-party providers (Stripe). Free trials, if offered, will convert to paid subscriptions unless cancelled.
All fees are non-refundable unless legally required. Prices are subject to change with reasonable notice.
To the fullest extent permitted by applicable law (in particular German law):
6.1 The Provider is liable without limitation for damages caused by intent or gross negligence, as well as for injury to life, limb, or health.
6.2 In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to typical and foreseeable damages.
6.3 Liability for data loss is limited to the typical recovery effort that would have been required if regular and proper backups had been made by the user.
6.4 The Provider assumes no liability for damages resulting from:
• Interruptions or failures of the internet connection.
• Use of hardware or software that does not meet the system requirements.
• Display crashes or software failures where a local backup variant was available but not used.
The services, including all software, text, images, and logos, are the property of the Provider or its licensors and are protected by copyright laws. You are granted a limited, non-exclusive, non-transferable license to use the services for their intended purpose.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.
The exclusive place of jurisdiction for all disputes arising from these Terms is the business location of the Provider in Germany, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
Should individual provisions of these Terms be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
